American ginseng is classified under Appendix II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, also known as CITES. This is an international treaty designed to protect certain plants and animals from exploitation that could threaten their existence in the wild. In 1975 ginseng was added to CITES Appendix II because of concerns of over harvesting driven by international trade and high price value. Cites consists of 3 different appendix levels. Appendix II allows for trade that is sustainable and legal, covering species that are not currently endangered but could become so without adequate trade management. In order to help ensure that American ginseng roots are harvested in a legal and sustainable manner, exporters must obtain permits from the U.S. Fish and Wildlife Service. It is our collective responsibility to ensure that ginseng does not get reclassified as an appendix III endangered species, in which case the wild ginseng trade will be shut down completely. If we all do our part by educating each other, understanding and following all federal and state level laws and whenever possible, do our best to go above and beyond any minimum legal requirements, ginseng will not only survive the pressures of man, but it will thrive.
Most states have very similar harvest seasons, selling seasons, laws and regulations, although each individual states specific guidelines may vary slightly. Canada as well as a few US states have completely banned the collection of wild ginseng but the NY and PA programs are both alive and well. Both states ginseng programs are reviewed annually to ensure that they meet all the federal requirements under CITES. It is important that you know, understand and abide by these laws because both NY and PA take the conservation of wild ginseng very seriously and any penalty they issue may not be just a slap on the wrist.
